Terms of Service
These Terms of Service govern your use of the Nia website, mobile application, and related services provided by Nia Payments.
1. Agreement to the Terms
By creating an account or otherwise using Nia, you agree to these Terms. If you do not agree, please do not use Nia.
2. About Nia
Nia is a family-support app for diaspora families, provided by Nia Payments. Depending on what’s enabled for your account, Nia can: (a) help you plan and track family support you arrange yourself, (b) send money on your behalf to a family member through Nia’s payment partners, or (c) extend you short-term credit, from Nia’s own facility, to fund a transfer or cover a specific support obligation.
When you send money through Nia rather than arranging it yourself, Nia acts as a remittance provider: your payment is collected by our payment processor and disbursed to your recipient through our local payout partner, subject to standard compliance checks (identity verification, sanctions screening, and transaction limits) that can place a transfer on hold or require additional verification before it completes. When you draw on a Nia credit facility, Nia is a direct lender for that draw: a human reviewer approves your limit, and any amount you draw is a debt you owe Nia on terms shown to you before you confirm — approval is never an automated decision, and Nia does not use aggressive or third-party debt-collection practices.
A support plan you create in Nia is a planning record on its own. How it actually gets paid depends on you: you can arrange it yourself outside the app, in which case Nia is not a party to that payment, or you can fund it with a real transfer or credit draw through Nia, in which case it is real money movement or real credit on the terms shown to you at that time.
3. Eligibility
You must be at least 18 years old and legally able to agree to these Terms.
4. Accounts
You must provide accurate information when creating and maintaining your account, keep your access credentials secure, notify us promptly about any unauthorized access, and avoid sharing your login codes with anyone else.
5. User-entered information
You are responsible for the accuracy of the information you enter into Nia, including family-member information, amounts, dates, purposes, notes, and obligations. Nia organizes the information you provide; it does not independently verify it.
6. Reminders and planning information
Reminders are a convenience. You remain responsible for your own obligations and deadlines. We do not guarantee delivery of any reminder, and we do not guarantee that a deadline will be met. Nia does not provide professional legal, tax, accounting, or financial advice.
7. Prohibited use
You agree not to use Nia for:
- Illegal activity or fraud
- Impersonating another person
- Unauthorized access to any account or system
- Uploading malicious code
- Misusing another person’s information
- Harassment
- Attempting to bypass security controls
- Interfering with the operation of the platform
8. Third-party services
Some functionality relies on third-party technology and financial-services providers, described in our Privacy Policy. Reference to a third-party provider does not imply that provider endorses Nia.
9. Intellectual property
Nia branding, website content, software, and related materials belong to Nia Payments or its licensors. You may not copy, modify, or distribute them without permission.
10. Privacy
Our Privacy Policy explains how we collect, use, and protect personal information.
11. Account suspension and termination
We may suspend or terminate access to Nia if we reasonably believe these Terms have been violated, or if necessary to protect the security or integrity of the service. Where practical, we will provide notice.
12. Account deletion
You may request deletion of your account at any time. Instructions are available at niapayments.io/delete-account.
13. Service availability
Nia may occasionally be unavailable due to maintenance, technical issues, service-provider interruptions, security events, or updates. We do not guarantee uninterrupted availability.
14. Disclaimers
Nia is provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim warranties of any kind, express or implied, regarding the service, including its accuracy, reliability, or fitness for a particular purpose.
15. Limitation of liability
To the maximum extent permitted by law, Nia Payments’ aggregate liability arising from your use of Nia is limited to the amount, if any, you paid to Nia Payments in the twelve months before the claim arose. We are not liable for indirect, incidental, or consequential damages, or for losses arising from your own arrangements to send or deliver funds outside the app.
16. Indemnification
You agree to indemnify Nia Payments against claims arising from your misuse of Nia or your violation of these Terms, to the extent caused by your own actions.
17. Governing law
These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada.
18. Changes to the Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised “Last updated” date.
